Who We Are
This privacy policy applies to enact-systems.com and any other websites owned by ENACT SYSTEMS Inc. (“ENACT”, “ENACT SYSTEMS”, “we”, “us” or “our”) that do not post a different privacy policy (collectively, “Sites”) as well as any information provided to or collected by us in providing you the Subscription Services. Capitalized terms have the same meaning given to them in our Terms of Service. Your log-in on our platform through login page or similar page, indicates you agree to signing our Terms of Service or your accessing or using the Subscription Services constitutes your acceptance of the terms of this privacy policy as revised from time to time.
What Information We Collect, How We Get It and How We Use It
User Entry . Most of the information we collect that could personally identify an individual (often called “Personally Identifiable Information”) is voluntarily entered by you when you order the Subscription Services, create a user account, identify Authorized Users, use the Subscription Services to enter Customer Data, send us a question via e-mail or otherwise contact us. Examples may include name, username, e-mail address, mailing or street address, phone number or similar contact information and customer solar system information including location. We use this information to provide and improve our Sites and Subscription Services, to respond to your request and to communicate with you regarding matters related to our Subscription Services (e.g., should there be a need for a planned interruption of service for maintenance). As provided for in our Terms of Service. We also may use this information to perform analytics on our Subscription Services.
Technical Usage Information. We also log or collect some technical information such as IP addresses, browser type, operating system information and page viewing history via cookies and other automated mechanisms. Although this information by itself usually does not personally identify any individual, our system architecture will link it with other Personally Identifiable Information. We use this information for internal research and development, for example to improve our Subscription Services and Sites, to provide support and to enhance your user experience such as faster webpage loading.
Sharing Information with Others
We utilize certain third-party entities, vendors and subcontractors to help us provide our Subscription Services and Sites to you and to process related data, such as data storage facilities, technical infrastructure providers, third-party sites for ease of account log-in, security vendors and payment processing companies, and we may provide your information to such third-parties, and/or permit such parties to collect the same through our Sites or Subscription Services, as reasonably necessary to provide our Subscription Services and Sites to you. Some third-party companies, such as payment processing facilities, may ask you to enter your Personally Identifiable Information directly with them and may provide some or all of that information back to us. All third-party use of your information is governed by the privacy policy of the applicable third-party, and we disclaim any and all liability for a third-party’s actions, links, services and products.
Should we undergo a change to our corporate organization (for example, merger, acquisition, financing or other corporate event), we may provide your relevant information, including but not limited to Customer Data, to the relevant entity and reserve the right to do so. In rare circumstances, we may need to disclose your information (a) in response to a subpoena or law-enforcement procedure or as we otherwise reasonably believe we are required to do so by law, regulation or governmental authority, (b) to preserve our rights or property, or (c) to protect the personal safety of someone in an emergency, and we reserve the right to do so.
We may share, transfer, sell or otherwise distribute aggregated, non-personally identifiable information publicly, such as to demonstrate usage trends of our Subscription Services. We may also identify the business names of our customers on our Sites and in our promotional materials as provided for in our Terms of Service
Third-Party Collection of Personally Identifiable Information
Our Sites and Subscription Services do not knowingly permit or facilitate any third-party to collect Personally Identifiable Information about your online activities over time via the Sites or Subscription Services, except to the limited extent described in this policy such as by our vendors.
How We Protect Your Personally Identifiable Information
We take reasonable steps consistent with industry practice to protect your Personally Identifiable Information from loss, misuse, unauthorized access, disclosure, alteration or destruction. No measure of security is foolproof, so please keep this in mind when deciding the information and Customer Data you choose to provide through our Sites and Subscription Services.
How to Update, Correct and Manage your Personally Identifiable Information
Should you wish to update, correct or otherwise manage any Personally Identifiable Information you have provided through the Sites or Subscription Services, you may do so through your online ENACT SYSTEMS account. You may also contact us at helpdesk@enact-systems.com for assistance. We may retain your Personally Identifiable Information for an indefinite period as provided for in our Terms of Use, but at a minimum for the duration of your use of our Subscription Services.
Do Not Track Signals
Our Sites and Subscription Services currently do not support the ability to respond to “Do Not Track” signals or other similar mechanisms that may be emitted from a user’s device.
Changes to this Privacy Policy
Should we decide it is useful or helpful to make changes to this privacy policy, a revised version of the policy will be posted at this location indicating the date such revision becomes effective. Your continued use of any of the Sites or Subscription Services will constitute your acceptance of the revised policy, subject to the amendment procedures described in our Terms of Use.
Governing Law
We are located in California, U.S.A., and this privacy policy will be governed by California law without regard to any conflict of law principles. By using any of the Sites or Subscription Services, you submit the jurisdiction of and within the State of California. You acknowledge and agree that the use and transmission of your Personally Identifiable Information as described above, along with any data or information you provide to us or enter into the Subscription Services, may occur within and/or outside of the U.S.A., including in jurisdictions that may have less protective data protection laws than the region in which you are situated, and that your Personally Identifiable Information may be stored and processed manually and electronically through global systems and tools for the purposes described in this Privacy Policy.
